REIT Election

On May 13, 2010, Wells Timberland REIT, Inc. (the "Registrant") elected to be taxed as a real estate investment trust ("REIT") under the Internal Revenue Code of 1986, as amended, beginning with its taxable year ended December 31, 2009. To continue to qualify as a REIT, the Registrant must meet certain organizational and operational requirements.
