Wichman Law Firm Wins Case for Budding Athlete Against Kansas High School Activities Association

Wichman Law Firm has won a case against the Kansas State High School Activities Association (KSHSAA), which accused defendant Jaylen Burch of violating rules relating to tuition and the furthering of his sports career in his transfer of high schools.

About the Case

Burch grew up in a troubled family and attended school sporadically so that he could take care of his family. After noticing his lack of warm clothing during a youth team football practice, the Keeney family stepped up to help him, and ultimately his siblings, with their wardrobes. Soon, Burch became a part of their family and started his next school semester at the same catholic high school as the Keeney children, with a tuition scholarship for at-risk youth. 

The issue started when Burch switched schools, and the KSHSAA found that he had violated their rules, stating that he had transferred schools to further his sports career, and that his tuition was further paid for in furtherance of the same.   

Because of all this, the KSHSAA deemed Burch ineligible to play sports or participate in other extracurricular activities. His family was outraged and began their search for the best attorney they could find. The Appeal to the KSHSAA

When Wichman Law Firm took on this case, the firm knew of no one who had ever won against or even appealed against the KSHSAA before. It wasn’t necessarily Wichman’s niche, but he knew he had the skill set to win the case.

“To my knowledge, no one had ever appealed a decision such as they requested, let alone won. However, I was able to figure out in theory how it was supposed to be done,” said Wichman.

Wichman’s goal was to show the court that Burch’s intention of switching schools was not fueled by finding success in sports but was rather fueled by the charitable actions of those around him. The unfairness of the quick judgment that Burch was switching schools for other reasons needed to be heard and rectified to allow him to continue living a normal high school life and join KSHSAA football.

At first, the KSHSAA denied their appeal after holding a hearing on the matter. However, on a second higher appeal of that decision, which would now be the final appeal, a new and smaller board was able to hear the case, and a decision was able to come through in Burch’s favor. This last appeal ultimately overturned the other denials and allowed Burch to participate fully in his school activities. 

“In the end, I was very glad that the highest level of the Association was receptive to our arguments and chose to overturn the initial decisions after being provided with more information at the hearings,” said Wichman. “It was great to be able to help this young man change course in life and set a new path where he could use his gifts to be successful and to assist with and reassure the efforts of the Catholic and Christian families who were living out their faith in loving their neighbor with their charitable efforts towards him.” 

Where Burch is Now

After winning his case with Wichman Law Firm, Burch went on to make the varsity team for football as a running back. He also competed individually in track, and won the State Championship for Kansas in the 100m dash in his junior year, and came in third in his senior year.  In his final semester, he got top grades and even became homecoming king.

He is now in the midst of his first semester at Morningside University, where he’ll also play football. Burch has become the first in his family to graduate high school and attend college, and, if he keeps up his excellent work ethic, graduate college as well.
